On Monday 10 June 2013, a number of minor changes to the Immigration Rules have been published which will come into force on 1 July 2013.


Changes to the Immigration Rules, July 2013

They include:
*changes to the documents required for approved English language tests;
*clarification that 'regulated financial institutions' means those regulated to provide personal savings accounts or student loans
*more legal courses are now exempt from the time limit on study for Tier 4 student visas.
*a resident labour market test is not needed for applications for a religious worker (Tier 5) extension.
Other changes include:
*Some minor updates and clarifications to the family Immigration Rules
*Changes to the list of financial institutions in Bangladesh and Ghana from which documents can be verified.
*Tuberculosis screening is now required in more countries including:

UK judges attack government over cuts to legal aid for migrants


The UK's legal establishment has united in condemnation of plans by the government to limit the right of some immigrants to the UK to receive legal aid in immigration cases. The UK's Justice Secretary Chris Grayling, announced plans to bar immigrants from receiving state funded legal assistance until they have lived in the UK legally for twelve months. Among those who would lose the right to legal aid would be 'illegal visa overstayers, clandestine entrants and failed asylum seekers'.
Mr Grayling's plans form part of a series of cuts to his department's budget which have caused concern among the nation's lawyers. The UK's Coalition government is dedicated to cutting billions of pounds from government spending which it believes is now at an unsustainable level. The government is faced with a large budget deficit which it is seeking to reduce.
Mr Grayling has also announced proposals to remove eligibility for legal aid from most UK citizens and to change the system so that defendants in criminal cases will be provided with a state-appointed solicitor rather than choosing their own representative as they do at present. Law firms will bid for contracts to provide services for a geographical area and will then be allotted all cases of defendants born on certain dates or with surnames beginning with certain letters of the alphabet.

Major changes in Australia’s visa programmes outlined in annual report


The last year has seen some major changes in visa programmes in Australia which are outlined in the latest annual Migration Trends report from the Australian government. One of the biggest changes was the introduction of the online skilled migration selection register, SkillSelect in July 2012. SkillSelect allows Australia to invite the best and brightest migrants by facilitating their ranking and selection on the basis of their qualifications, work experience and language abilities.
Major change was also prompted by a report known as the Knight Review which came up with 41 recommendations for the student visa programme. The Department of Immigration and Citizenship said that it has now implemented more than half of them. These include the introduction of streamlined visa processing where eligible students, regardless of their country of origin, are assessed as though they are lower risk and have reduced evidentiary requirements.
Reforms to the Business Skills visa programme began in July 2012. These reforms are designed to better attract people with entrepreneurial talent and a successful business history to Australia. ‘Included in the reforms are a reduction in the number of different business skills visas, which is intended to provide a clearer pathway to permanent residence and an innovation points test which includes points for financial metrics, registered patents, trademarks and evidence of export trade experience,’ said a DIAC spokesman.
The visa application process is being simplified. The department’s visa simplification project, an initiative designed to reduce the number of visas, simplify the visa application process and improve integrity continued through 2012. As a result the number of different skilled visas has decreased from 27 to 11 and the number of temporary visas has gone from 17 to eight.
The Migration Programme is the main option for permanent residence in Australia and has two main categories; the Family Stream which enables the migration of immediate family members and the Skill Stream, which targets migrants who have skills, proven entrepreneurial ability or outstanding capabilities that will contribute to the Australian economy.
In 2011/2012, the Migration Programme delivered 184,998 places of which 125,755 went to Skill Stream migrants. The Family Stream outcome for 2011/2012 was 58,604 places, a 7.4% increase on the 2010/2011 level. The planning level for the 2012/2013 Migration Programme is 190,000 places, an increase of 5,000 places and the highest figure on record. Of the additional 5,000 places there are 3,400 Skill Stream places, 1,585 Family Stream places and 15 more places planned for Special Eligibility.

Depending on the purpose and duration of their visit, people can come to Australia on either a visitor visa or a temporary resident visa. Visitor visas are mostly used by people visiting Australia for holidays, tourism, recreation, or to see family and friends.

The Working Holiday Maker (WHM) Programme aims to enhance cultural exchanges and international relations with arrangement countries and has grown strongly. In 2011/2012 some 214,644 working holiday visas were granted, an increase of 15.7% and the highest number on record. In 2011/2012 some 253,047 visas were granted to international students, a rise of 1% and the first increase in student visas since 2008/2009. The decreases in student visa numbers in 2009/2010 and 2010/2011 followed 11 consecutive years of growth.

Latest figures show UK immigration missing visa processing targets


The latest figures released by the UK government show that the UK immigration authorities managed to process only 51% of employment based UK visas within their Service Standard period (four weeks for postal applications) in the year 2012-13.
They were only able to process 25% of student visa applications within the service standard. Their service standard target was to deal with 65% of employment visas and 85% of student visas within the service standard period of four weeks.
The figures show that this performance was markedly worse than in the year 2011-12 when UK immigration dealt with 81% of employment visa applications and 78% of study visa applications in a timely manner. There is, as yet, no explanation for this woeful performance.
The total number of visas that were made was more or less the same in both years so there was no added pressure on the service. Throughout the period in question, senior staff at the UK Border Agency (UKBA) had been assuring UK politicians that the performance of the UKBA was improving.

Australia is rated best place to live and work for third year running



Australia is the best place in the world to live and work, according to the Organisation for Economic Co-operation and Development.
The UK, by contrast, comes 10th in the OECD's Better Life Index, behind the US, Canada and the Scandinavian countries. Britain did, however, fare better than Germany and France, which were ranked 17th and 18th respectively.
Australia retained its place as the world's happiest industrialised nation for the third year running, boosted by strong indicators for health and housing. Life expectancy in Australia is 82 years – two years above the OECD average, while 90% of people say they are satisfied with their housing situation, more than the OECD average of 87%.
Australia – which enforces compulsory voting – also scored highly for public engagement, with 93% turnout at the recent elections. That compares with just 66% in the UK, and the OECD average of 72%.
The UK, by contrast, scores well for income and employment but poorly for work-life balance. About 12% of employees work very long hours, more than the OECD average of 9%.
Average disposable income for households in Britain is £17,800 a year, above the OECD average of £15,300. But there is a considerable gap between the richest and poorest, with the top 20% of the population earning nearly six times as much as the bottom 20%.
The Paris-based thinktank measured 11 topics to gauge general wellbeing in a country, comprising community, education, environment, civic engagement, health, housing, income, jobs, life satisfaction, safety and work-life balance. Turkey was the lowest ranked of the 36 countries the OECD surveyed, with poor readings for almost all the topics.
Countries hit by the eurozone crisis were notably low on the list, with Portugal and Greece ranked 28th and 30th respectively. Both scored poorly on employment: in Greece some 56% of people aged 15 to 64 in Greece have a paid job, while in Portugal the figure is 64%, below the OECD average of 66%.www.imperialvisas.com
