UK will limit immigrants' right to challenge immigration decisions


Chris Grayling, the UK's Lord Chancellor, (as the justice minister is called in the UK) has announced changes to the justice system which will limit the right of people to use the courts to challenge decisions made by the UK immigration authorities. The changes are due to come into force this summer and will bar some people from bringing 'judicial review' (JR) against immigration decisions and increase the costs of doing so.

Mr Grayling says that immigration solicitors have been using JR as 'a cheap delaying tactic' and he is therefore determined to limit its use. 77% of JRs are brought in immigration cases.

JR is a legal proceeding whereby someone who believes that a public body (such as the Home Office) has made an unlawful or incorrect decision can apply to the UK's High Court for a ruling that the decision was wrong in law. The court can order the public body to reconsider its decision and to pay damages.

Mr Grayling and officials at the UK's Ministry of Justice are concerned that the number of JR applications has been rising in recent years. There were 6,692 applications in 2007 and 11,359 in 2011. Of those made in 2011, 8,734 were against immigration decisions.

The UK Supreme Court’s judgement in Alvi, given on 18 July 2012, established the following general principle:


‘Any requirement which, if not satisfied by the migrant, will lead to an application for leave to enter or remain being refused is a rule within the meaning of section 3(2) [of the 1971 Immigration Act]'.

This means any requirements must be agreed by Parliament. This agreement is gained by putting the requirements into the Immigration Rules. Spain's immigrants leave as recession continues


The population of Spain has fallen for the first time since records began according to the Spanish National Statistics Institute. The latest figures show that the population of Spanish citizens grew very slightly by 10,000 people but the number of registered foreign residents fell by 216,000 resulting in a net population fall of 206,000 to 47.1m.

The Spanish economy has been in turmoil since 2008 when the global economic crisis caused a collapse in the Spanish housing market. Since then, matters have been made worse by the fact that the Spanish government has had to cut expenditure because of the crisis in the Eurozone. The lack of opportunity in Spain with an unemployment rate of 26.6% has resulted in some foreign residents leaving the Country. Youth unemployment currently stands at 50%.

Spain's economy grew rapidly from the mid-1980s until 2008 when like many other countries around the World was affected by the economic crisis. Much of the growth in Spain in the past was fuelled by a construction boom. Many people came from around the Spanish speaking world to work on Spanish construction sites. Immigrants came from Latin America and also from Romania and Morocco. The number of registered foreign residents rose from less than 1m (924,000) in 2000 to nearly 6m (5.7m) in 2010.

UK immigration runs pilot of visa expiry 'reminder' service


The UK's immigration authorities have announced a new scheme to remind foreign nationals in the UK when their visa is close to expiry. The pilot scheme has already started.

The Home Office will run the scheme in concert with the private sector outsourcing firm Capita. Capita has run similar services for the Home Office before and attracted criticism in the press for its performance.

The Home Office has randomly selected a proportion of those whose visas are due to expire in June 2013. It has asked Capita to contact everyone in this sample by letter, email or text message to remind them that their visas will expire soon. The communication will advise the selected visa holders to either apply for a new visa, for a visa extension, or to prepare to leave the country.

Capita will send a further reminder one month before each visa holder's visa is due to expire and another seven days before the expiry date.

Former UK immigration boss says system has been out of control since 2000

The former head of the UK Border Force (UKBF) Tony Smith says that Britain lost control of its immigration system between 2000 and 2003 under the Labour government of Tony Blair. He said 'There was a huge influx and frankly I don't think we have ever recovered from that'.

Mr Smith has worked in immigration enforcement for nearly thirty years. In 2012, he took control of the UKBF which was the agency responsible for the UK's frontline immigration activities such as passport control and customs control at airports, seaports and railway stations.

Mr Smith said that the influx of illegal immigrants between 2000 and 2003 was so great that UK immigration staff were unable to do anything about it. He told The Sun newspaper that many of those that arrived then have since changed their names and are now untraceable.

Airline boss says UK immigration system is putting off foreign business people


Willie Walsh, the chief executive of International Airlines has warned that the UK's visa system is deterring foreign businesspeople from travelling to the UK. Mr Walsh was addressing the World Travel and Tourism Council summit in Abu Dhabi on 10th April 2013.

Mr Walsh was the chief executive of the UK's largest airline British Airways until it merged with Spanish carrier Iberia and became International Airlines. He is now the chief executive of the merged company.

Mr Walsh said 'I get lots of criticisms and complaints from business people when I travel around the world, particularly in growth economies like China, India and Brazil. You talk about investing or doing business in the UK and they all point to the difficulties, the bureaucracy and the cost associated with getting visas to travel the UK and highlight the advantage of the Schengen Agreement where they can get access to 26 European countries at the cost of less than the price of a UK visa and less hassle.'

UK immigration grants new Tier 4 Sponsorship licence to LMU

The UK's Home Office has issued a new Tier 4 sponsorship licence to London Metropolitan University (LMU). The Home Office made the announcement on 9th April 2013 and said the licence would be effective immediately. LMU's previous Tier 4 sponsorship licence was revoked on 29th August 2012.

A Tier 4 sponsorship licence allows a UK educational institution to sponsor potential students from outside the European Economic Area to apply for a UK Tier 4 student visa. You cannot obtain a Tier 4 visa unless you are sponsored by a licenced UK educational establishment.

On 29th August 2012, the UK Border Agency, which was until 1st April 2013 in charge of UK immigration control, revoked LMU's sponsorship licence. The UKBA claimed that it had done so because LMU had not put systems in place to ensure that international students

2014 H-1B quota reached on April 5th 2013

As Imperial Visas predicted, demand for H-1B visas this year has been extremely strong. The US Citizenship and Immigration Services (USCIS) received 124,000 applications for H-1B visas by 5th April 2013.

Every fiscal year, USCIS issues 65,000 H-1B visas to foreign graduates enabling them to travel to the US to work in a 'specialty occupation'. It also issues a further 20,000 H-1Bs to foreign graduates with advanced degrees such as master's degrees.

The US fiscal year begins on October 1st. (Fiscal Year 2014 will begin on October 1st 2013). USCIS accepts applications for each fiscal year from the preceding April 1st. So USCIS began accepting applications for H-1Bs for 2014 on 1st April 2013.

Australian government criticized for misleading immigration figures


The Australian immigration minister has released figures which show that there were 12% more Temporary Work (Skilled) (Subclass 457) visas granted in February 2013 than in the same month in 2012.

Mr O'Connor said that this sharp rise justified the plans of the Australian government to reform the 457 visa system to prevent abuse of the system or 'rorting' as it is known in Australia. Critics say that most 457 visa applications are not fraudulent and that the visas are issued to foreign workers who are filling genuine gaps in the Australian labour market. They also say that the February figures have been taken out of context and are misleading because the number of 457 visas granted has actually been falling since August 2012.

In March, Mr O'Connor said 'Rogue employers are deliberately employing people from overseas without giving a local a chance' and called for a reform of the 457 visa system. On 3rd April, Mr O'Connor said 'The 457 increase continues…which…underlines the need to bring about the reforms so that the 457 visa is used for the purposes it was constructed – which, of course, is to fill temporary shortages'.

UK MP warns against immigration 'arms race'

A senior UK MP has warned the leaders of the main UK political parties against getting involved in an 'arms race' in immigration policy. Keith Vaz MP, the chairman of the influential Home Affairs Committee, has said that the leaders should, instead cooperate to face 'one of the most challenging issues our nation faces'.

Mr Vaz expressed his views in the pages of the Sunday Express, a British newspaper which runs stories and comment pieces weekly about the perils of immigration.

Mr Vaz said that the leaders of all three major parties should 'listen to the British people'. Mr Vaz, the Labour MP for Leicester East, himself an immigrant who came to the UK aged six in 1965 with his Indian parents, says that the British people have been 'incredibly tolerant [of immigration] in the past but they cannot stand abuse of the system. What is needed is not an arms race on immigration policy among our party leaders but a new consensus…Messrs Cameron, Clegg and Miliband should now sit down together and talk about this issue' in order not to give fringe parties an 'opportunity to fill the vacuum'.

Think tank says scrapping UK immigration authority could be a mistake

The Institute for Government, a London think tank which aims to encourage more effective government, has questioned whether the abolition of the UK Border Agency (UKBA) announced last week is a good idea.

Sir Ian McGee, a former senior civil servant and now a fellow at the Institute, has issued a statement saying 'Restructuring creates an impression, superficially, of action to solve problems. The acid test is will performance improve as a result? It is unclear that the organisation…will be significantly improved simply by shuffling the pieces'.

Last week on 26th March 2013, Home Secretary Theresa May announced the abolition of the UKBA which is an independent agency that was established in 2008 to deal with the UK's immigration administration.

Australian immigration cuts number of visitor and business visa types

As of 23rd March, the Australian government has reduced the number of visitor visa sub classes from nine to five. Australian immigration minister Brendan O'Connor said it would simplify the system aeliminate red tape.

The changes have been introduced as part of Australia's Visitor Visa Simplification and Deregulation Project. In a statement on the Department of Immigration and Citizenship (DIAC) website, Mr O'Connor says that this is a simplification only and that there will be 'no change to current visa eligibility for tourism, business visitor activities, sponsored family visits and medical treatment and care has been taken to ensure there is no impact on program integrity settings'.


There is one new visa announced; the Temporary Work (Short Stay Activity) visa (subclass 400) which will allow people to stay in Australia for six weeks for 'short-term, highly specialized non-ongoing work. It seems that the new visa might be of particular use for performers and other creative people travelling on tour to Australia.

UK ministers considered barring children of illegal immigrants from schools


The Guardian, a national UK newspaper, has received a leaked email trail from UK civil servants which seems to show that UK ministers considered the possibility of preventing the children of illegal immigrants from attending free UK state schools to prevent 'education tourism'. It seems that any such plans were quickly dropped but ministers are now considering asking schools to check on the immigration status of both pupils and their parents as part of the admissions process.

An Oxford University study suggests that there are approximately 120,000 schoolchildren in UK schools who are in the country illegally.

The emails between civil servants in the UK's Department for Education (DfE) seem to show that a group of ministers had considered barring the children of illegal immigrants from the education system as part of the Coalition government's efforts to eliminate the 'pull factors' which draw some migrants to the UK.

However, the emails also seem to show that, if the ministers did consider such a move, they rejected it pretty quickly, perhaps because civil servants advised that to do so would breach Article 26 of the UN Convention of Human Rights.

MPs quiz civil servants about UK immigration and visa services

On Tuesday 26th March 2013, a committee of MPs interviewed two senior civil servants about the way the UK's immigration services will be run in future. The interview came just minutes after the Home Secretary, Theresa May, had made a surprise announcement that the UK Border Agency, the body that deals with immigration and asylum in the UK, was to be abolished.


The Agency was founded by act of parliament in 2008. It was given Agency status in an attempt to give it independence from political interference but the effect of this independence, Mrs May said, was a negative one. Mrs May said that the UKBA had, developed a 'secretive and defensive culture' in part because it was an agency. The UKBA will be abolished at the end of the financial year on April 5th and its functions will be reincorporated into the Home Office.


By chance, the Home Affairs Select Committee, which has oversight of the running of Mrs May's department, was in session on the afternoon of the 26th March, just minutes after Mrs May made her announcement. The Committee was also due to interview Rob Whiteman, chief executive of the UKBA that afternoon.

Main UK immigration body to be abolished because it is 'not good enough'

The UK's Home Secretary, Theresa May MP, has told the House of Commons that the UK's main immigration authority, the UK Border Agency (UKBA), is to be split because it is 'not good enough'. She says it will split into two bodies one of which will deal with UK visa applications and the other with finding and removing illegal immigrants.
Mrs May made the surprise announcement to MPs in the House of Commons on Tuesday 26th March 2013. She said that the UKBA 'struggles with the volume of its casework which has led to historical backlogs running into the hundreds of thousands. The number of illegal immigrants removed does not keep up with the number of people who are here illegally and while the visa operation is internationally competitive, it could and should get better still'.
Mrs May's announcement took most people by surprise. Last week, the UK's immigration minister Mark Harper issued a statement saying that there were continuing improvements at UKBA.

UKBA was failing to meet most targets

But on Monday 25th March 2013, the Home Affairs Select Committee, a committee of MPs charged with oversight of the running of the Home Office, which includes the UKBA, issued a damning report which said that the UKBA was failing. The report said that between July and September 2012, the agency failed to meet its targets in most areas. Among the report's criticisms of the UKBA were the following;
It processed only 18% of Tier 1 visa applications made by post within the UKBA service standard target of four weeks
processing only 14% of Tier 4 applications within four weeks
It processed only 27.5% of all visa applications within the four week target
It failed to process over 25% of premium visa applications within 24 hours, as its service standard said that it should
It has cleared only a quarter of a backlog of 450,000 asylum cases in the last seven years leaving 312,000 unresolved
'Secretive and defensive culture'

Mrs May blamed the last Labour government for the 'secretive and defensive culture' at the UKBA. She said 'The UKBA was given agency status [by former Labour Home Secretary John Reid] in order to keep its work at arm's length from ministers. That was wrong'. She said it was this that had caused the secretive culture at the agency.
Dr Reid set up the UKBA in 2006 after staff at the Immigration Directorate, which was then responsible for asylum claims, found a previously hidden backlog of 450,000 asylum cases which had accumulated over a decade and had been left in packing cases.

Dr Reid then abolished the Immigration Directorate and established the UKBA. He pledged that the asylum backlog would be wiped out in five years. On Monday 25th March 2013, The Home Affairs Committee published a report which said that over 312,000 cases remained in the backlog and also went onto say that they would not be surprised if more cases were found. At the current rate, the report said, the backlog will take 24 years to clear.

Last year, Mrs May split the UK Border Force, which is responsible for policing the front line of the UK's borders from the UKBA, which is responsible for asylum claims, immigration decisions and finding and removing illegal immigrants.

Smaller organisations are easier to run

Mrs May said that, since the split, the performance of the UKBF had improved which showed that smaller organisations were more efficient and easier to run. She said that what remained of the UKBA would be split again so that one body would deal with visa applications and the other would be responsible for law enforcement.
The Chairman of the Home Affairs Select Committee Keith Vaz, Labour, said that this was the right decision and would put the UKBA 'out of its misery'. He said that his committee had been calling for this to be done for many years.

Yvette Cooper, Labour's shadow Home Secretary said that the performance at the UKBA had got worse than ever in the last year since the split. She said 'queues at the border went up. Border Force presided over some of the longest queues our airports have ever seen. And things got worse at the Border Agency too. The select committee report showed a 20% increase in the backlog of asylum cases in three months'.
